These Terms of Service explain the rules that apply when you access tcgxchange.co.za, create an account or purchase products from TCGXchange.
1. Agreement to These Terms
These Terms of Service apply to your use of the TCGXchange website and to purchases made through our online store.
By accessing the website, creating an account or placing an order, you agree to these Terms of Service together with any other policies referenced on this page.
If you do not agree to these terms, you should not use the website or place an order through TCGXchange.
2. About TCGXchange
TCGXchange is a South African online Trading Card Game store offering sealed TCG products, board games, accessories and related products to collectors and players.
TCGXchange is based in Cape Town and provides online ordering and nationwide delivery within South Africa.
3. Using Our Online Store
By using our online store, you confirm that you are legally able to enter into a purchase agreement or that you are using the store with the involvement and permission of a parent or legal guardian.
You may not use the website or our services for any unlawful, fraudulent or unauthorised purpose.
4. Products and Availability
All products displayed on the website are subject to availability.
While we make reasonable efforts to keep stock information accurate, displaying a product as available does not guarantee that the product will remain available until your order has been accepted and processed.
TCGXchange may limit, cancel or adjust quantities where necessary, including where supplier allocations, stock discrepancies or other availability issues occur.
5. Product Information
We aim to provide accurate product names, descriptions, images, specifications and other product information.
Product images may be provided for illustrative purposes and minor differences in packaging, promotional artwork or product presentation may occur.
Trading Card Game products may also contain randomly assorted contents. Purchasing a sealed product does not guarantee any particular card, rarity, pull or outcome unless specifically stated otherwise.
6. Pricing
Product prices are displayed on the website in South African Rand unless otherwise stated.
We make reasonable efforts to ensure prices are accurate. However, pricing errors may occasionally occur.
If we discover an obvious pricing error before an order is dispatched, we may contact you to correct the price or cancel the affected item or order where appropriate.
Pre-order products may also be subject to the pricing terms described in our Pre-Order Information.
7. Placing an Order
When you place an order through TCGXchange, you are making an offer to purchase the products included in that order.
Receipt of an order confirmation does not necessarily mean that an order has been finally accepted or dispatched.
Orders remain subject to matters such as payment confirmation, product availability, stock verification and any applicable fraud or security checks.
8. Order Acceptance and Cancellation
TCGXchange reserves the right to decline, cancel or adjust an order where reasonably necessary.
Reasons may include:
- A product becoming unavailable
- A stock or inventory error
- A clear pricing or product-information error
- Supplier allocation restrictions
- Suspected fraud or misuse
- Payment not being completed or authorised
- An incorrect delivery area or address
Where an order is affected, we will contact you where reasonably possible.
9. Quantity Limits and Adjustments
We may limit the quantity of a particular product that may be purchased by a customer.
TCGXchange may also adjust quantities after an order is placed where stock allocations, supplier restrictions or availability make this necessary.
Any such adjustment will be handled on a case-by-case basis.
10. Payment
Orders must be paid using one of the payment methods made available through the checkout process.
You are responsible for providing accurate billing and payment information.
Payment processing may be carried out by third-party payment providers. Their own terms, security procedures and privacy practices may also apply.
TCGXchange does not require access to your complete payment card details in order to fulfil an order where those details are securely processed by a third-party payment provider.
11. Pre-Orders
Products identified as pre-orders are subject to additional conditions regarding payment, estimated arrival dates, supplier allocations, fulfilment and shipping.
Pre-order payments are non-refundable.

12. Shipping and Delivery
Delivery times are estimates and cannot always be guaranteed.
Delays may occur because of courier disruptions, public holidays, weather, high order volumes, supplier delays, customs or other circumstances outside of our reasonable control.
Customers are responsible for providing a complete and accurate delivery address when placing an order.

13. Delivery Issues
If there is an issue with the delivery of your order, please contact us as soon as possible so that we can assist with the courier or delivery provider where appropriate.
Customers should inspect delivered parcels promptly and report damage in accordance with our Refund Policy.
14. Returns, Exchanges and Store Credit
Returns, cancellations, exchanges and store credit are governed by our Refund Policy.
Certain sealed Trading Card Game products cannot be returned or exchanged because of the nature of those products.
Pre-order purchases are subject to the separate terms set out in our Pre-Order Information.
15. Consumer Rights
Nothing in these Terms of Service is intended to exclude or limit any consumer right that cannot legally be excluded under applicable South African law.
If any part of these terms conflicts with a mandatory legal right available to you, that legal right will continue to apply.
16. Customer Accounts
You may be able to create a customer account to manage orders and other account information.
You are responsible for keeping your login information and password confidential.
You should notify us promptly if you believe your account has been accessed without your permission.
17. Information You Provide
You agree to provide accurate and complete information when placing an order, creating an account or contacting TCGXchange.
This includes your name, contact details, billing information and delivery address.
TCGXchange cannot be responsible for delays or delivery issues caused by incorrect information supplied by a customer to the extent permitted by applicable law.
18. Promotions, Discounts and Store Credit
Promotions, discount codes, special offers and store credit may be subject to additional conditions.
Unless otherwise stated, promotions cannot necessarily be combined with other offers and may be withdrawn or changed where reasonably necessary.
Store credit is subject to the conditions set out in our Refund Policy.
19. Prohibited Use
You may not use the TCGXchange website to:
- Commit or encourage unlawful activity
- Attempt to gain unauthorised access to the website or another account
- Introduce malicious software or harmful code
- Interfere with the normal operation or security of the website
- Submit false, misleading or fraudulent information

Product names, logos, artwork and trademarks belonging to Pokémon, Wizards of the Coast, Konami, Disney, Bandai or other publishers remain the property of their respective owners.

Third-party services operate under their own terms and privacy practices.
TCGXchange is not responsible for the content or operation of an independent third-party website that we do not control.

We aim to keep the TCGXchange website available and functioning correctly, but uninterrupted access cannot be guaranteed.
The website may occasionally be unavailable because of maintenance, updates, technical faults, security issues or circumstances outside of our reasonable control.

We reserve the right to correct errors and update information when they are identified.
If an error materially affects an order you have already placed, we will contact you where reasonably possible.

TCGXchange will not be responsible for delays or failure to perform an obligation where the delay is caused by events genuinely outside of our reasonable control, subject to applicable law.
Examples may include severe weather, courier disruption, strikes, internet or infrastructure failures, customs delays, supplier disruption, natural disasters or government action.

These Terms of Service are intended to be governed by and interpreted in accordance with the laws of the Republic of South Africa.

If TCGXchange does not immediately enforce a provision of these terms, this does not automatically mean that we have permanently waived our right to enforce that provision.
